my son moved in with me he 15 years old and he hads typ 1 dibeit and i'am on disableity he get's is own check and get my own he also get money form me and now they cut him off ,cause he live with me can they do this. please some help me out here.

It really depends on what type of disability benefits you each have. Are you two on Supplemental Security Income (SSI) or Social Security Disability Insurance (SSDI)? Post that information here and I can explain more.

Whenever SSA makes a change to someone's benefits, they send a letter explaining why. Often the letters are difficult to understand. Did you receive such a letter? If so, what did it say? If not, call SSA and ask them to resend it. 1-800-772-1213.

The laws are written to protect the Government from fraud without any feelings or give room in them, so contact a lawyer about making your son an emancipated minor instead of your dependent. I know that it doesn't really change anything but the wording but it might make all the difference in the case you are facing.If it happens that way then make sure you show where he is paying rent to you every month for his room. He must show that he is living on his own and supporting himself. Don't make the rent to much as you must report it as earnings to the IRS, also ask the lawyer how that will affect your status on your claim.
