It depends where you live, in Canada the government looks at common law couples as married and you file your taxes as a married couple.

Else get it registered in the country where u wish u to file taxes.

No you cannot as most states and the irs does not recognize common law. So you had better file single . Or else be preparred for the consequences. good luck .
