He told me and myhubby that his going to break the lease and that the lease office knows, but that not the problem he tol us that if were going to keep the same apartment that he wants us to give him his 250 from the down payment. We told him no because he breaking the lease. What should I do???? Help!!!!!!!!!!!

Go talk to the leasing office. Inform him that if he want's off the lease, the leasing office needs to handle his deposit. It's not in your hands, it's in their hands. He's not subletting through you, I assume, as he says he's spoken to the leasing office, so you are not responsible for his deposit.

Well first of all did he sign the lease with you?
Did you talk to the lease office yet , maybe he is just saying he talked to the lease office but really didn't, people do lie.
You tell him when you move out, he gets his money back until then he will have to move on and keep in touch. He can't do anything about that money since the lease is being broken because he wants to go, its his tough luck. If you broke the lease you wouldn't get your money back either.

First of all check the lease agreement to see what it says.If he is breaking the lease he might not be in the position to get back his down payment. Try and negotiate with him about finding a new flatmate.

If he is breaking the lease take him to court you possible can sue him for his share of the rent for up to 3 months untill you find another room mate within a certain time..

Tell him that since you don't have his deposit, you can't give to him. Plus, deposit is not always 100% refundable. A lot of times it is partially withheld due to repairs, etc. Tell him you will get in touch with him when you vacate the apartment and maybe you will give him some money back.
