i signed a lease at my apartment complex in oregon. a week into my lease, my grandmother passed away and i had to return to my home state (hawaii). its been about 2 months since my lease has started and i am still in hawaii, as i am trying to help my family out during this time. i would like to break my lease, as i am unsure of the exact time frame that i will be in hawaii... i have paid my rent every month and have yet to even step foot in my apartment. is there any way that i am able to break my lease with out having to pay all those fees involved?

The concern of the landlord is that the rent is paid, but most people are reasonable. My recommendation would be to contact the landlord, explain the situation and then ask them to put the property back up on the market. Since you've never been in it, there is nothing to clean or to do to make the property ready for the next tenant, so they should be willing to work with you. If it's clean and ready to go you should be able to break the lease when the new tenant take up residence. They may be willing to break the lease earlier knowing the circumstances.

Make sure you send them your request certified, return reciept requested by mail. Keep a duplicate copy of the letter you send - notarized if you want to go to the extra step before it's mailed. That way they will know you really are in Hawaii and you will have a copy of your intent to pay them fees due on a reasonable basis.

Have you tried reaching an agreement with your landlord? If they arn't willing to compromise check with Oregon Legal Aid (1-800-228-6958), Fair Housing Council (1-800-424-3247), or the Renters Ombudsman organization.
