1st Degree Manslaughter:
1.∆ intends to cause serious bodily harm to an individual, but instead causes the death of the individual or a third person.
2.EED - ∆ intentionally kills individual or third person, but does not constitute murder because ∆ was acting under the influence of extreme emotional disturbance. Reasonableness is to be determined from the viewpoint of a person in ∆’s situation under the circumstances as ∆ believed them to be.
a.Subj: Did ∆ act under EED?
b.Obj: What would a reasonable person believe under the circumstances as ∆ perceived them to be (consider unique physical traits of ∆ but not psychological-framing is key depending on Pros or ∆)?
c.EXAMPLE: People v. Casassa (256) - ∆ killed V. The two lived in the same building and casually dated until V. ended it. ∆ was devastated. Evidence of actual EED – eavesdropped on her on dates from the apt. below her, broke into V.’s apt and laid in her bed naked while V. was out. On day in question V. rejected ∆ when he brought her wine and liquor.
