I have made about 15000/years less the last three years. I can still afford what I pay but it would be nice if it was a couple hundred less a month. I pay 900/month plus all the kids insurance, for 2 kiddos. and I live in Kansas.

Actually yes, and you could have done so a long time ago. Any time there is a change in the financial situation you can request another court date to reevaluate the support amount. You will have to prove how much income you have, and so will she. Child support is based on the amount both parents make, number of children, etc. As long as she is not making less money now, you should be able to have the amount you pay lowered substantially. Child support does not increase as children grow older. The age of the children has no impact on the decision of what amount should be paid. Even if you do not have an attorney, each state has guidelines for child support, and the judge can determine the amount based on the info you and the mother provide. The only catch is that you MUST be current on your support to request this hearing.

You need to find out if Kansas uses a formula to determine child support. If so, find a site online and plug in the numbers - your income, her income, insurance costs, daycare costs, etc. You will then get a good idea of what the current support order would be. If it is only reduced by a small amount it makes no sense to spend the money for attorneys and court fees instead of paying the money to your kids. If it is a large reduction you should try and see what it would do to your kids to not have the money to use - would it mean they have to give up certain acitivites?

a court will re evaluate how much you make but they will also keep in mind the cost of living does go up so really the odds are against you. Though a court will put child support on suspend in some states if you loose a job or cant work for medical reasons and tell the court b/f you stop paying what your ordered to be paying. so i would suggest talking to your lawyer.

So, you make approx. $416.00 less per month, than you did prior ... that seems significant enough, in order to have your maintenance order re-evaluated. But, this also depends on how long ago this order was put into place. It could end up back-firing on you. If the judge feels that, due to inflation ... your child support is insufficient, he/she may raise it. It's a hard call ... sometimes, it's better to leave well enough alone.

No, if you mess with it you will probably have to pay more. Cost of living increases as the kid gets older.

You'd have to take it up with the court. they would re-eval your earnings and base it on that.
