Currently there are 51 Democrats, 49 Republicans, but Cheney gets to cast a tie-breaking vote. One of the Dems is in the hospital (Sen. Johnson SD) so basically it's 50-49 with Cheney holding the trump card.

49 and 49. 2 independents who caucus with the democrats to make things easier. the one guy that is in the hospital isn't that big of a deal since on any given day a good portion of the senate doesn't show up for work anyway.
