Short answer: Yes - if you agree to it.

Everything is negotiable before the lease is signed. Once it is, you can only amend by mutual agreement.

If you are in an area where the rental market is depressed or are such a stellar tenant you believe you have the bargaining position to demand the landlord remove this requirement - give it a shot. He may understand the business sense of getting a good tenant over quibbling about a couple of hundred bucks.

If, on the other hand - you're in a hot market and there is competition for the type of property you're looking at - consider the potential outcome if you force the issue and the landlord decides to do his business with someone less troublesome.

It all depends on the real estate laws in your state and what you agreed to in your lease. I would start with the lease and see if there is a clause in your lease that states he can withold money from you if refuse to repair or clean the apartment.

If there is nothing in the lease, then you could be free and clear.
