Does my Uncle have to put his fence at least 3 feet away from the property line?
We have had surveyors come out and put pins in the ground to mark our land. They keep disappearing. He is wanting to put a fence up for his horses. Many people are telling me that he has to put his fence at least 3 foot inside the property line. I want to tell him this but need to find proof.

I am certain he has moved the landline markers several times. They have gone missing twice. Also he was really picky when we dug a ditch along our driveway. Water drains from his property as well in this ditch. He told us we needed to put the ditch on our side of line which we did. Now he's putting up a fence and it looks like its going on our land. I will probably have to call and pay a surveyor again.

Laws differ from city to city. Contact your planning department to find out the laws.

If you do another survey, take a photograph (with the surveyor there) of where the markers are.

A land survey for the properties should tell you if there are distances that needed to be followed. He could build the fence but the city or county could have it removed if they have claim on the few feet they have access to.
