The courts usually decided what is best for the kids, and after age 13 allow for their comments or preference. If he is getting custody, I have to ask Why? Did you give them up? Did you cause the divorce over drugs or worse? It is highly unusual for the father to get custody, especially with the girls. The one thing you BOTH have to remember, it is not about you or him now, but them. This question leaves to many other questions before a complete reply can be given.

I tend to agree, at that age they are old enough to have some say in where they end up. Do what's right for them, not what could hurt their dad the most. If their dad has a stable home, then let them go live there for awhile.

Your question is more of a statement by the way. You might want to put some more thought into giving details so people can give you better advice.

Not going well for who, you or them? At that age they are old enough to make the decision who they want to live with. If they are having problems are they problems of a 12 and 15 year old, or are the problems from the father?

At ages 12 and 15...they are legally old enough to choose which parent they wish to live with. Most judges will honor the childs wishes at this age unless there is a very good reason not to (like abuse, neglect, substance abuse)
