Hi! Im 5 months pregrant now and just lately my boyfriend told me that he is married, and dont want to take credit for our baby b'coz he said he is incapable of having a baby in a normal sex... I am very much sure that he is the father of my baby, he is only my boyfriend and no one else, and im very much sure of that. I want to sue him for lying to me about his status. He also told me that he wanted to be with me and the baby... Can you help me with this? tnx

If the DNA proves he is the father, it doesn't matter what he says or wants - it is his child too and he will have to pay for it (and explain to his wife how this happened). Get a lawyer and find out what your local laws are regarding this.

It is called a paternity suit and you will need an attorney. You will both have to give a DNA sample (mouth swab) to prove that he is the father.

It will NOT be about YOU but child support and his responsibility toward the CHILD.

If you win the judgement will be limited to child support, maybe medical insurance for the CHILD, expenses for birth and maybe a college fund at best.

Get an attorney through legal services if you can't afford one and they will advise you. You are NOT going to get a BIG personal "hit" unless he is a "high roller" and you agree to some personal settlement; just get it in writing and NOTORIZED TOGETHER if you settle this way.

You can file a paternity suit after the baby is born, and have him compelled to take a paternity test. If he is the father of the baby, you can sue him for child support.

Just to clarify, first he said he won't take responsibility for the baby because he is incapable of having children, and then he says he wants to be with you and he baby? Which is it? Regardless of what he may be saying, you need to take care of yourself and your baby and make him take (at minimum) financial responsibility.

Go get a lawyer, now. You do have a claim to child support IF the child is his (the court won't make that determination without a paternity test). You may have other claims indeed. Go see a lawyer. Many offer free consultations.

One the baby is born - force him to take a paternity test to prove if he's the father or not.
If he is - then you can sue for child support.

Doubt you could get an attorney to sue him for lying but you can sue for child support if the child is his.
