It is illegal. Tell him to turn your check over to you or you will report him to the labor department. Of course you will be looking for a new job (which you probably should anyway if he is accusing you of stealing.)

Do you still work there? If you are owed money and you dont work there, tell them they have must put the check in the mail for you and tell them a certified request is being send with this same request. Should you not get the check within 10 business days, you will seek legal action. Don't talk to them at all unless its they arranging for you to pick up the check.

at my workplace, if employees are suspected of wrong doings, the employer would take up the case and conduct a domestic inquiry (that's when an independent committee is set up to investigate & report). remember you're innocent until proven otherwise. take it up to higher authority or the labour office. what ever it is try settling it amicably before any drastic measures taken.

first find another job, then have him/her prove it through a court of law, with them paying the cost of court and the laywers fees. and with the any damages that you may have incurred (missed work, damage to your name, the lawyer can explain the rest). this is in fact a federal case... go after the b*#&erd.
