courts tend to favor the mothers, especially since you have been the primary care giver for the baby. men are clueless in the care of babies, the court knows this. get a lawyer, if you can't settle it with out a fight.
try to always be functional parents for your child.
children are not tools, they should be loved and cherished.

You are right about leaving this guy. For him to verbally and physically abuse you is wrong. If he wants to go to court, let him. The court usually favors the mother (if she is the primary caregiver of the child), and income only plays a part of it, so don't worry too much about that part. The most important thing the judge will consider is the overall well-being of the child. If you tell the judge exactly what you wrote on here, with the abuse and all and hopefully have witness to it, there is NO WAY the judge will grant the father sole custody. Talk to a lawyer. You should seek legal aid as soon as possible.Will your family support you?Just because he has a steady income that does not mean that he makes the best custodian of a child. At this age the child needs a mother.How would he care for the child?Has he thought of that?There is a lot more to child rearing than what your boyfriend thinks.The fact that he physically and verbally abuses you goes a long way in your favour.

In the court system, it favors the mother keeping the children first. Unless it deems you a unfit mother, by some stretch of the imagination, they will grant custody in favor of the father. Girl you gotta get out of there take your kids and start a new life, but just get out of there. He is in attack mode and he is trying to scare you, from your independence because he wants to keep you under his thumb. He doesn't want you to leave his control, and will do anything to manipulate you to stay. Be strong you can do it!!!! Find the courage within and be brave, and give your children and you a better future. ( Don't let him manipulate you)

If you have no legal paperwork saying anyone has custody, you probably can do whatever YOU need to do for your child. He would have to seriously prove that you are an unfit mother to get total custody. Especially if you have been smart and called the police for any DV.
