I worked at a place for a couple of months just to see if I liked it. Well evidently I didn't so I quit. After which I had to go in and pick up my last paycheck. Well it's been over 6 months since that happened and here it is the first of February and I haven't received my W-2. I called the place and they are not mailing them out, but you have to come and pick them up. Isn't this against the law? What if you moved to another location and are not near the place to go pick it up? Plus there was no notification that previous employees were to pick them up and not receive them in the mail. I believe this is against the law because aren't all W-2's to be mailed out and received by January 31st? Who can I contact to deal with this issue to ensure that they send out all those W-2's to the previous employee's unaware of the situation and to make sure that this doesn't happen again. There should be consequences.

Bu law they have to mail them out by January 31. If they still have them and say you must come pick it up, I would call the IRS.

As an accountant, I have never heard of a place unwilling to mail a W2. The law requires that the w2's be completed and an attempt to deliver be made. Personally, I would just go in and get mine. I cannot imagine a bookkeeper wanting a trail of past employees tramping thru her office however. You have the option of reporting the company to the IRS but this is only after you have made legitimate effort to get the form. They will issue them a request at that point but I don't think the IRS would get too harsh with them. I would go get my own form and let other employees deal with that when theirs does not arrive. I am sure they will call and ask for them.

W2's are required to be postmarked by 1/31. So, if you don't receive one within a reasonable amount of time you should contact the company. Give them a week and contact them via mail explaining that you did not receive your W2 and when can you expect to receive it.

Yes there are penalties associated with not mailing them on time. Perhaps they've exploited a loophole.

In any case, you are required by law to report any income received regardless of whether or not you receive a W2 or not. If you have your last paystub, you should have enough to do so.

There are consequences for them. By law if you haven't picked it up from them, they need to have mailed it out. Contact the IRS, and maybe Better business bureau. It's illegal for them to hold it after the 31st of January, and you can actually take legal action against them, and if you alert the Federal Government, they will intervene, because they are violating federal law. GO for it, man.

If you aren't working there, they have to BY LAW, mail it to you.

In fact, even if you are working there, if they don't personally hand it to you or you pick it up, they have to mail it to you.
