I live in a private apartment owned by somebody who does not live in the unit. The 2 family house is for sale, I live upstairs. If the house ever sell, can the new owner evict me? I am in a month-to-month lease.

Your lease remains in force, so you have to be given whatever legal time required to vacate. On a month to month lease, I'd expect 30 days (to the end of that month, so 30+ days) is right, though you should review your lease.

Have you called your landlord to see what the new buyer's intentions are? There's a good chance that they want to keep you as a tenant, and use the other half, or keep renting both units out. But, if they want to move into your unit, it'd be nice to know.

Call the landlord and see what he says.

You should look up your state law. I think generally the owner will have to give you a month's notice. You should be looking for a new place to live, because the current owner will not want a lease to complicate selling the house. In practice you will probably have some time from the offer until settlement, to work out with the new owner if you can sign a new lease.

of course. most the landlord needs to give you is 30 days notice unless your lease states otherwise. see if you can get a 6 month term or longer...

Yes because you are in a month to month lease...they have to give you some sort of notice that they are not renewing.
