What are our options to get her name off of the mortgage? Should we contact an attorney? If so what type?

They were never married and in Nebraska there is no common law marriage.

The mortgage company would be a good place to start.

Family law and real estate attorneys would also be a good idea.

Hopefully, her name is on the deed to the house too. If this is the case, then try to take heart in knowing that he can't sell the house without her.

We're they married when they bought the house? Are they divorced now? If they were divorced, this should have been taken care of in the divorce. If they were not married, or have not yet gotten divorced, then they will need to go through the process. If they were never married, she needs to get an attorney, and there are steps to be taken to be removed from the mortgage.

You may need two different types of attorney ... a divorce attorney and also a 'property attorney' (if they have a special name for this, I don't know what it is) ... but talk to the divorce attorney FIRST, even if they were never legally married, because the attorney you choose will have the names of other attorneys that he works with, and a property attorney should be one that the divorce attorney knows.

An attorney may charge you for the consultation. Why not start with something free? Your girlfriend should talk to the mortgage company.

sounds like they are not legally divorced or this would have been taken care of in the divorce papers...no there is nothing u can do to make him refinance..however, this is a problem for your g/f to decide upon...

Start moving your stuff in, tell him if he doesn't want to refinance then you'll just have to live there with him.
