My employer issued me, in writing my new commission stucture for 2007 back in December 06. Just before the year ended I landed a large order that created a very large backlog, which would result in some very large commissions. Now a month later they are telling me that because of my large backlog they will cap the amount of commission I can make. Is this legal if they already sent me the new structure in writing and there was no mention of a cap in the original?

Most of the time an employer has some sort of loop hole. We just went thru something like this with my husband's job and our attorney said they could change their mind. My husband even signed a contract regarding his bonus. He said as long as it was the company "giving" you the bonus or commission or whatever, it was their choice.

Something similar happened to me - my comp plan got changed right at the end of the year as I was closing a big deal. Despite the fact that my original plan was signed, and in writing, my company told me when I came on board that they reserved the right to change commission plans at any time, without notice, so I was left holding the bag.

I don't think what they are doing is legal, but chances are they probably reserve the right to do that somewhere in the fine print... maybe you should take that up with someone at your firm who is a neutral player, and see if it is something you have the grounds to fight...

I'm not sure but a good idea would to be query the dept of labor and a labor lawyer as it seems you have a binding legal contract, is this change only for you or is it accross the board for everyone??

Does seem right to me. But try talking to your Boss or your Boss' Boss if you have not done so already.

Right and legal are two different things.

Are you willing to walk from you job over this? ... because to big of a stink can result in problems.

An employer can do what he wants. If he changes the structure, that's it. But it looks like he's a jerk who wants to get in on the money.
