just wondering. somebody told me that if you get caught cheating by your spouse, they can get you arrested!

Some states may still have laws on the books about such things, but I doubt whether they are enforced anywhere in the U.S. We'd hear about it, I'm sure.

Edit: So many people were sure it wasn't illegal in the US that I had to look it up. There ARE still laws in place in as many as 26 states making adultery a crime. It is likely that, if challenged, those laws would be found to be unconstitutional, but the fact is they do still exist. Illegal No. If marry someone you are cheating with while you are still married it's called polygamy and is illegal.

Cheating and getting caught can cost you dearly when divorce time comes. Kids, stuck in the middle if your cheating your "spouse" could get full custody based on infidelity and unstable home environment.

Cheating/ Adultery is not against the law.

It is however a good way to lose custody of your children when the cheated upon spouse decides to take revenge!

Cheating, well i guess if you cheat playing cards in vegas,that states you are stealing, and stealing is against the law, But if you cheat on your spouse,that is a whole different ball game..,

It depends on where you live. There are some states where it is illegal, but the law is not enforced. There are many laws that are still on the books but would exhaust the criminal justice system if enforced. Anyway....if you are married you shouldn't cheat on your spouse because it is immoral, not because the legality issue.

I agree with Smeather on this one!! And they should be hung by, oops! that's right this site is rated G... well, I'd say we should have this put into law.... but that would mean it would have to pass through the Senate, and after Clinton, I'd bet MOST of them are cheaters too, and would never pass such a law!! We need "Chastidy Belts" to make a come back!

Cheating? ... It's usually labeled as "adultery" if you are married and generally called "cheating" if you're not.

Presently, there is one state pending legislation to make adultery a felony criminal act. They base this upon the fact that adultery often destroys a family, just as much as a murder or some other terrible crime. I think the state is North Carolina but can't remember for sure.

No, but believe it or not, you can sue for breach of contract in terms of violating wedding vows. Very few cases of this have ever come to court because both parties would have to testify, it would get VERY ugly, and the financial benefit would not be that great considering assets are typically split 50/50 anyway.

I've never heard that but I'm sure in some states it may be true. There are some weird laws on the books. Some states in their laws say it's illegal for a man and woman to live together. Anal sex is against the law in some states. Oral sex too. I figure it's nobody's business.

no you cannot get arrested but if you'll reach a point of divorce and the money has to split the person who was caught cheating cannot get anything. its like britney and k-fed. he wants half of her money, but he was caught cheating in Las Vegas in 2005 after marraige. so now he cannot have anything.
