My brothers were wrongfully convicted for burglary, charges were dropped, the real suspects confessed. we spent $5,000 for a lawyer and extra 2K on bail. We, along with our lawyer (who didn't do much) filed a wrongful arrest lawsuit against the Police Dept. and city. Its been a year and the lawyer doesnt return my calls. Is it possible we won and he just took the money and ran? Who can I contact for with a problem like this? The D.A. or some kind of lawyer association or maybe another lawyer? Please help.

State/local bar association; send them a letter of complaint and send him a copy

Are you paying Him? If so lodge a complaint with the bar assn and get a new lawyer. If you arent (sounds like yer basically a 3rd party in this) Then he has no obligation or reason to call you at all, you arent a paying customer... Nor a client..

IN FACT the lawyers discussing his clients(your brothers) ANYTHING with you could easily be considered a violation of Attorny client privilege.. and that would def get him into trouble..

You not being a party to this action you have no rights in this action basically. Being simply a relative doesn't grant you any rights at all actually...

Unfortunately most lawyers can and do avoid their clients. Your best bet is to contact the local bar association or the Disciplinary board and report him if you think he took money that was owed to you. Probably not much action to be taken if there was no money taken and he is just avoiding you. You could always send a letter to the local paper about his lack of courtesy.

Sure it's possible he took the money and an, but not very likely. This action would cause him to get disbarred. Chances are he's in court. I always had a problem getting a hold of my lawyer.

However, if you want to file a complaint, call your state's attorney generals office. Of course you can always go to his office.

It's more likely that he never filed a suit or he filed a suit and lost and didn't have the guts to tell you...this isn't that unusual, particulary among lawyers who practice alone rather than in a firm. If I knew which state you lived in I could tell you what to do...but if you google on the terms "attorney discipline" and "Kentucky" (or whichever state you live in), you should find the proper authority to report him to. If this happened to you, it might have happened to other people as well, and maybe he'll get disbarred or suspended from practice.

Contact the local bar association and ask them for assistance in filing a complaint.

Did he take a retainer? If you gave him a retainer or escrow money which wasn't all spent, and he owes you money, then you should report him right away.

Lawyers are a deceitful bunch. He probably figures it was money well spent on your part and well earned on his part. He probably fells he is not obliged to return your calls without a further retainer. Sorry about that.
