On Friday, August 18, 2006, Don Vito was arrested at the Colorado Mills Mall in Lakewood, Colorado for allegedly groping two underage girls (12 and 14 years old)[1] inappropriately at an autograph signing and subsequently held with bail set at $50,000.[2] He posted bond around 10 p.m. the following Monday. As a condition of his bond Margera was ordered not to possess any alcohol, drugs, weapons and is not permitted to contact the victim. Additionally, he cannot leave the state of Colorado.[3]
As a result of the arrest, the stunts involving Don Vito were removed from the theatrical release of Jackass 2, but several stunts were briefly shown in previews leading up to his arrest. Due to the nature of the charges, he was also declared unwelcome among the Jackass cast and crew.
I don't hink Bam's show takes place in Colorado so he can't be a part of it.

I;m not positive, but I read somewhere that he was in jail for touching minor girls!
