we have moved in and finished the work ourselves. we paid the subs for the work they had to finish and we had a construction loan. the builder recieved payments for the work completed ,he is trying to get the money for work that wasnt finished.besides being 2 months over contract.

If they have a lien, they can foreclose. Generally this will be because of unpaid balances due them for work completed thus far.

A mechanical lien can't force a sale, in most states, I am sure!
Especially a lien where the work hasn't been completed. You probably need legal help on this one, in the State where you live!
I think, the work has to be completed, to know what the amount
owed is? I notice you say, though, "Builder" ... and -- not finished the work? You are living in the house? There would have to be a completion notice filed b4 occupying, I am sure?
Mechanical Liens, that I am familiar with, are for workers or SUB-Contractors who have not been paid, for their work, by the General Contractor (Builder) or the owner?

There is not enough information here. Did you close on the house, were payments set up? Did you miss payments? I believe that you may benefit from a meeting with an attorney in any case. The builder has control of the property until you move in but you have rights too!! Good luck.

If they got a mechanic's lien, then they can foreclose. It's time to get a good lawyer.

Get a real estate attorney asap. Pull out your contract as well.
