police dept said no as long as they do not remove anything.my son caught boy hand in grandmothers mail box stoped and confronted boy boy states no english my son slaps the boy boy gets asault charges on my son yet he is held responsible for his actions the boy is not although his actions caused the actions of my son .18 mounths probation & 215.00 fine for stoping a theif from stealing his grand mothers ss check. not justice to me .

He stopped a thief. Once that mail is in the mail box, it is the property of the adressee. He was defending the property of another, and should as such have the fine lifted. I would get a better lawyer.

Well.. here's the deal. Your son took the law into his own hand. Your son decided to be police, jury, judge and 'executioner of punishment'. You son deserves to be charged with assault and he needs to understand that the police and laws are there to protect everyone. Had he not assaulted the other person but instead contacted the authroties and reported the problem, the other person would have problems now and not your son.

You and he both need to understand that violence begets violeance and our police and criminal justice system is in place and designed to reduce violence. Your son instigated the violence in this situation and therefore was the one to be punished for it.

Oh.. obviously you have left out some of the important details because people don't get sentenced to a year and a half of probation for a simple 'slap'.

Perhaps invest in a lockable mail box. Under $20 at your local home depot or lowes? About the assault, it is what it is. Simply call the police next time, never strike another person or even touch them as that is assault.

My b/f had someone open his mail and he contacted some credit report place and his bank in case. So I thing I depends on how you go about the situation. B/c now he has all this security in his information cards and everything.

it is unlawful to interfere with someone elses mail without peremission, a federal offense. however, it is also against the law to slap someone. your son is not one to take laws into his own hands. he should have called the police on the young man and had them handle the incident.

As long as they don't open and read the mail it is not an offense.

And nobody has the right to hit another person unless it is in self defense, protecting property is not such a situation.

Both were in the wrong. The kid was breaking the law by going into her mailbox, and your son was wrong for hitting him. You cant go up and hit someone for just getting in your mailbox. Get real. You should have just called the cops on him.

Suggest you contact a lawyer, maybe can clear son's name.

Suggest grandmother get direct deposit, too.

No it is not legal, but what you describe was overkill. You kid should have called the cops and let them handle it.
