Depends on what your colleague did. Did he complain about his bosses? what can they do other than whine. Or did they slander the company? that's more serious. But if he's already tendered his resignation, they've already got what they can take - his job.

They may want to sue your colleague, because he has tarnished the company's reputation. It depends on how badly the damage he has done. Some damages can cause loss of profits and they will have every reason to sue him.
