Hello, My landlord decided to make major repairs on the building I leave on. These repairs will take two months from 8:00 AM till 5:00 PM M-F.

I want to break the lease because I cannot be in the apartment during the day and sometimes I work third shift making it impossible for me to rest.

Can I break the lease because of that?

NOW, this advise is only if he is repairing the INSIDE of your apartment
Go to the Landlord and explain to him about your work shift and that you will be sleeping during the times he has a work crew there. Request, in writing, that he either put you up in a motel for those 2 months or release you from your lease with no penalties. If he will release you, make sure you do a walk through inspection with the LL on the day you leave and have him sign it stating that you caused no damages. This way, if the work crew damage something, your landlord cannot say you did it and you would get your deposit back. Make sure he understands that the normal 30 day notice will not work in this case because you have to leave ASAP due to the circumstances. .
If he is repairing the OUTSIDE of the building, other than asking to let out of your lease, there is nothing you can do. 8am to 5pm are normal working hours for any work crew. They cannot work during your work hours.
Yes, quiet enjoyment is in NORMAL circumstances. Your work hours are NOT during what is called normal work hours 8am to 5pm. These hours are when contractors work. While I feel for you, he is not in violation of your lease. So the answer is NO, you cannot break your lease because of it. You can only ask to be let out of your lease.

He's supposed to go to all lengths not to disrupt your life, and preform only necessary work. So if he's redoing the roof because it leaks, I think you may be SOL. However, if he's redoing the kitchen because it's old, then you have a much better case.
