Does anyone know about the above case - it set a precedent in law wherby Child Maintenance arrears beyond 1 year were excused -there are also special cases where the arrear are not excused - i need to know what they are - if any one could help that would be great.

Good Question Peachy - N one saif anything about getting out paying - you never I might be trying to prevent someone from getting out of paying.....?
Or the situation may be such that one person has one child and the other has another - the first is on min wage and the second has a million in the bank....?
Never prejudge - ife is more complicated than that.

Again - more prejudgements! The question is not intended to get out of paying- it is a question about British law - precedent in law and common practice- the law is cold - not emotional.

I don't know of any case that set forth precedence to excuse child support arrears beyond 1 year. Generally speaking an excuse of arrearages is an exception and definitely not the rule. There are only a handful of reasons why a person's child support arrears would ever be excused.

Unless it is a new law I don't think you can get out of it. I know dads whose kids are in their middle twenties and the dad is still paying arrears. The only way I know you get 'excused' is if you do so many days in jail for every so many dollars you are behind. Or if you do not have a job and can not get a job and can prove you are trying hard to get a job they might be more lenient on you too.
If you receive SS disability you can sign up for your kids to receive the benefits based on your SS disability.

I hadnt heard of it but like to know the answer, could be helpful.

I asked a similar question last week and a lot of the answers i got back were pure nasty.....

some people are just too quick to make a judgement about others, and they usually get it totally wrong

Ask a solicitor, most first visits are free even if you are not due Legal Aid. Telling you this reluctantly as I don't think much of any man who isn't willing to pay for his own child.
