I am wondering if someone can own another business' specific domain name. Can someone else register xxx.com if my business is xxx? I know there is a market for selling domains, but if you have a registered business can someone else legally own your business' dot com name? What if your business is incorporated? Trademarked? What about issues with naming rights? Thanks for your answers in advance, I really appreciate it!

Thats why they call it a Wild West....Anybody can register anybody else's name....As of now and a lot of people have made a lot of money that way.

Hi I guess it may depend on how releveant your company name is.
For instance who uses AA.co.uk because the AA (Automobile Association) uses 'theAA'
In some circumstances it depends on who registered the name in the first place.

There us a rule about the .name domain which is that is must be either your name or your claim to your name.
You cant have delorean.name unless your name is delorean.

Actually nobody owns a domain they are simply registered with nominet. Although they can be sold on, like car registration numbers (uk)

It happens all the time. If you want that domain I would recommend you pounce on it. As long as they don't represent themselves as you there is really not problem.
