Let us assume that the as yet unofficial plot to kidnap,torture and behead at least one serving British soldier of Muslim religion is as reported.

Should the perpetrators be charged with treason-in as much as plotting to kill one of the Queens own surely must fall under the "crime of disloyalty to ones nation" heading-especially as the alledged perpetrators live in Britain as nationals and as such owe alliegence to the Queen by definition.

Are they therefore also traitorous, not only to the realm but to their faith?

cheers rhsaunders but what I meant, and maybe I wasn't clear enough, 'was traitorous to their faith' in as much as the target is Muslim and 'traitorous to the country' by way of as a national you have an automatic allegience to the Queen.

as much as it used to be hung drawn and quartered, and in the 40's hanging was still OK, nowadays it's 25-life for treason.
(and I know that's probably not gonna please the off with their heads brigade-sorry!)

Traitorous to the faith is arguable, and in any event not a matter for the civil courts, but treason would be a possibility. However, prosecutions for treason have been out of style for years, and the alleged culprits can be charged with conspiracy to commit murder, which (on conviction) would put them away for a very long time.
