Would parental abduction of a child (no custody) along with fleeing the state be considered a 'fugitive from justice" and if so, would would be the penalty for such a crime? Worst case?

Most states have kidnapping charges for such a thing. The non-custodial parent takes off with the kids.

I would surmise that the parent doing so may well plan on some time behind bars. Where I live, I guarantee it. Hard to say how long but figure on a few years.

I agree with the above - it's kidnapping, it's a very serious felony, depending on the circumstances, (i.e., turning oneself in after recognizing the severity of one's actions, the judge assigned, etc.,) would depend on how much time in jail would be imposed.
