The president. The senate has to approve the nomination, but generally has to have a very good reason not to. Hearings are held before a vote is taken. Only 30 out of 144 nominees has been rejected, the most recent being Robert Bork (Harriet Miers' nomination was withdrawn before the hearings). For more info. on the process, see link below.
