he pays 125 a month and is still behind cause we didnt know the child exsited untill about 3 years ago and then we cant get a dna test and they were not married and she didnt even live in our town but she chosse him out of 10 other guys plus she was married when she gave birth

Yes indeed they can! It depends on your judgment. If he owes ANYTHING AT ALL, regardless of whether he's paying on it, they can take it from his refund.

Yep....my ex had his tax refund taken away every year for back support.If you are married to this guy,make sure you either file separately or if you file together,fill out an injured spouse form to go along with your taxes.Otherwise they will take your refund too.

If you're $500 or more behind, they will attach all or part of the tax refund

Yes, but you have to petition for it. Get an atty and have them get a Judgment specifically against his tax return.

Yes, they can definately take your tax refund. I know several people that this has happened to.

who cares if she was married when she gave birth, he didnt seem to care if she was married when he was bang'n her.

besides; thats a moot point, for there is a child here they both produced.

YES they can take the tax refund, but only if there is a tax refund intercept (state and federal) in place. call the case worker and ask if there is one in place or not.

one more thing, i hope he didnt claim the child on his taxes (for the write off) unless he provided more then 50% of the childs living expenses for the year and the child lived with him for a certain period of time.

if both parents claimed the baby, the IRS will audit both of you; and the one with living expenses reciepts wins.
