My friend was arrested after a really foolish incident- going into his ex's apartment. He's being charged as breaking and entering. He's got a good job and hopefully he won't have any jail time. (His record WAS crystal clean.) Is there any way he could lose his job? Do jobs run random background checks?

but they could now easily fire him if they found out about the arrest and it would be within their rights to do so

No, employers seldom if ever do continual background checks. Bear in mind to that there is a difference between being arrested and being convicted. Get a good lawyer.

The implications very much depend on the job. If he has a position of public trust, has a security clearance, or if the news could cause public embarrassment to the employer, then his job might be at risk.

He might want to consider sharing this news in private with his boss - either for advice or just to make sure it doesn't come as a surprise if it comes to someone's attention at work. Somehow, these things always seem to come back and bite you.

If your friend does not attract any jail time, then I see no reason to inform his employer. unless of course, your friend works in law enforcement or a political organization where he might bring embarrassment or disrepute to his fellow employees if he ever was found out. Most employers do not ask an existing employee if they have been involved in any criminal activity, they often ask potential employees though. Should your friend apply for another job in the future then it would be wise and honest to tell the truth, some employers will take into account mitigating circumstances.

the best thing that he could do would be to "fess" up and explain
the situation, he was being dumb and at the time thought it would be a good idea (not) to get the rest of his stuff from his ex while she wasn't home. if there is any way that he can "sweet talk" his ex to drop the charges that will help to get it off his record.
and yes employers can (i do) run background checks at anytime
while they are under my employ as well as drug checks, they signed the employment agreement when they where hired.

Yes they can fire him for NO REASON AT ALL in the vast majority of states. He should be prepared for that to happen. "Random" background checks are almost never performed. I suggest he speak with his employer about the incident and make arrangements NOW for any absence he may have.
