This is a topic that came up at work I haven't failed its just a running bet I believe the physician only contacts the perspective employee and the the employer.My co-workers says the results go directly to the DOT.

you are right........others are wrong.

the dot doesn't give a dump whether you pass or not.........unless you violate the law. at that point passing or failing becomes an issue.

in other words, it is up to the employer to police compliance with the law regarding drug testing.

Your attitude tells me that your nothing but a punk kid. You don't have a case and no lawyer is going to take your case. Drug test results may be private information depending on how given. If given in a clinic then they fall under a medical test and are governed by the laws for all medical tests. If your employer purchased one of the numerous DIY drug test kits then no they are not considered medical record and are not bound by the same privacy standards. I am assuming by your pissy attitude in the Additional Details that you are a minor. In which case, medical record or not, your uncle had the right to know. Drug tests are done for workplace safety. The employer, employees and customers have the right to know that they are in a safe environment therefore they can disclose the results.

Naturally they get the test result. I don't think the employee gets anything except a letter letting the prospective employee know of their decision. If you are already an employee then the security takes you to the parking lot and makes sure that you go home straight to give the good news to your family or your bartender.

The employer . The doctor of course and the DOT .The doctor is required to submit all test results to the DOT .

Just the employer and the physican who did it for you. Probably should not be doing drugs and driving on the highways.

the DOT gets it if it involves a CDL license

i do know with the nursing board they send all negatives to the board also...you need to check the website of your states licensing authority.
