the man is still legally married but she won't give him a divorce? I am from another country but I may come there and live with him - but I don't want him to get in trouble. He's tried for years to make her leave (she's mean) and she won't. Anyway...would love to hear your thoughts. Is it illegal or anything?

Although living in partner was not in practice in India but now after coming up of MNCs in India & the influence of globalization not only in economic policies but also social practice this is being followed by many young couples. As far saying this what will society say about this, no one in big metropolitan cities like Delhi etc has any time to check individuals for this. You have not seen these places especially Delhi NCR area for some years so you don’t know much about these places, when you visit these places you will be amassed to see the changes here rather you may say these places look more like your own city or country. People specially working in MNCs are on job 24X7, they find living in partners & share room with them, and this is very much a reality now here too. Unfortunately foreigners see old Satyajit Rays Classic movies & think Indian is still living in slums but come & see new modern India & decide yourself if whatever I told you is true or not. As far legality of living in partners is concerned it is not recognized from legal point of view so there is no liability or responsibility that you can get enforced from the courts.

In the present situation you cannot live with him, as this will invite trouble to both of you. In India bigamy is illegal. One cannot have two wives at one time. He has to give divorce to his first wife. This has to be done through the court or outside the court.
Then you can marry the divorcee. If you have deep feelings for him and he reciprocates, then just get along with him.But it is he who has to take steps to seek divorce by filing a petition in the family court. Your living with him in the present situation will invite wrath from socialites, media, family members etc. I am sure you would not like epithets on your relationship. People may say that your his concubine, and call him a debauch and so on. Having said all that, I have great sympathy for your case and I respect your feelings, if it is indeed true that his wife is mean and that she has made his life hell. But all of this requires a proof.

Hi Jazmin! No, not illegal but I would totally keep it under wraps and make sure that you live someplace where no one knows him or his wife. Let people assume you two are married. Don't give anyone the details. There is nothing like a secret in India and the news would spread like wildfire. If her family found out they could create a major scene. Things here get out of control much more quickly than in the west and the law and order situation is not that great!

I just wanna share an true incident here.

I had a friend who fell in love with a married man. She loved him with bottom of her heart and knew that he was married. Altough she was in a belief that he was not happy with his marraige an his wife is the meanest creature in the world. After a few months of relationship they got physical. They did it quite often untill he suddenly moved out of her life. She was hurt badly and tried in vain to search for him. I was the one then who somehow gathered some information about the man and went to his house.

But once I went to his house I saw a completely different picture. Instead of his friend I felt sympathy for his wife because it's only then that I came to know that, it wasn't the man but the wife who was actually suffering.. She cried when I inquired about the man that he hadn't never comes in for weeks and never gives her money to spend on the family. She being uneducated has to work as a maid to feed her child and her mother-in-law.

Moral: Never trust a man if he's married and says he loves you...

No. You don't require divorce decree from Indian Court. ( Even though I am not a lawyer but aware of legal implications). One : Unless your Canadian Divorce Decree is contested by your Ex Husband in Indian Court as Fraud , then Indian Court may not recognize the Canadian Divorce Decree as valid ( since it is alleged to be obtain by fraud hence under dispute). Two :Canada is part of commonwealth Community hence Indian Court does give merit to it's decisions unless the case itself was encroaching upon some areas where Only Indian Court has its jurisdiction. Even if you were to go for registration of your marriage in India, your Divorce Decree issued by Canadian Court , would be acceptable to Registrar of Marriage as long as you produce True of Copy of same which is Attested by Indian High Commission at Canada. Dont worry about anything. PIO Card / OCI card is no connection to it.

Such living together with physical relations is not prohibited/barred in any Indian Law or is an offence and punishable under Indian Penal Code enacted in 1860, being amended from time to time. Yet some feel it sin and crime on their own belief. Unwed living together is unfair in my personal opinion. For marriage, both parties should not be in wedlock. jaz u did'nt explain he belongs to which religion,there is different rules for religion,in some cases she should have illegal connections and the lady should be not normalin condition or legaly two of them to sign for divorce or it will take 7years.[better not to make problems in that ladies life if it happens to u what will u do. sorry thanks bye.
