Wife Received Vechicle In Divorce .Note Is It My Name She Has To Pay The Monthly Payments Which She Never Does On Time My Bank Holds The Title To The Vechicle, I Have Checking Account With The Bank So They Just Took Out The Car Payments Out Of My Account Without Telling Me Can They Do This?

A copy of the divorce decree should be sufficient to rectify this, but you may want your attorney to contact them. Of course, if your account is still joint with her, the bank will consider it as payment from her.

Addendum: You added a critical piece of information to your post. Per the decree, your ex-wife is responsible to you to make the payment, but as the note is strictly in your name, YOU are solely responsible to the bank. Two separate issues here. In effect, you are borrowing from the bank to purchase the car. Then, you are selling the car to your ex-wife and carrying the note for her.

Yes the bank can. The obligation to them in IN YOUR NAME. When your ex got the vehicle in the divorce settlement, why didn't you have the obligation transferred as well. If she was not credit worthy, then she would have had to sell the vehicle and pay off the note.

Is it possible that she retained the vehicle but you are clearly responsible for the payments and the fact that she is making any payments at all is not part of the decree?

Something doesn't quite make sense here.

No one is above the law. They must have to go through the rule. If your divorce came after the car taken & if she had signed as ur wife in the bank statment then U have to pay the loan. But after divorce & statelment of money b/w u & her. U r not responsible to pay all her expences after the divorce. only condition is that what u committed in ur divorce paper. U can do one thing, Pls put a case against bank, spacially bank manger regarding the thratening. I think It will help u some extend Best of luck

Notify the bank and tell them you want your money put back in your account.If not,Pull your money out and put in a different account.
