My fiance and I have been together for 3 yrs and we have a 22month old together. Medicaid is taking him to court on my behalf, after I called and told them numerous time we are living together and have been for 3yrs. I went there and talked to my worker and she told me as long as we live together they won't take him to court for support. what should we do?

I'm sure once you get there to court and explain everything and have documentation, etc. they won't pursue it. Myhusband and I are seperated, but not legally, and all I've had to do so far is give them a letter from him ststing that he still supports our daughter financially. I think paperwork and red tape and gov't worker incompetance get confused and as a result, you go to court.

Ok if you have been living together for 3 years & your kid is only about 2 I don't understand why they wouldn't know this info from the get go. Like when you got pregnant did you straight off the bat tell them that you guys were living together? I need a little more info. I seriously think I can help you because I work in somewhat of that field & deal with Medicaid & social workers on a daily basis

Medicaid is looking to be reimbursed for any costs they have paid out for you. Since you are engaged and living under the same roof theyre holding him financially and legally responsible for you. Now if you werent engaged or living together this may have benn different. Basically by being honest youve screwed yourself. This falls under fraud as you probably applied for it when you were single or did so on paper, but now youre engaged and living with him and have a child together when you should be off medicaid and having him support you three, especially if he has a job. Hope this makes sense

In IL they will insist there is child support order to help pay for any state aid you are getting. If you live with him or not they will order support so that they can get reimbursed for what they pay for your child in aid IE medical. Not always nice but is what it is when you need state aid you have to follow they're rules. I've been there myself a few years ago, its not fun. Good luck

thats not necessarily true, unless your states laws are different.

in Va where i live, you can take your husband to court for child support. my sister has twins, and applied for assistance for child care and they told her if they did, that she had to file for child support from her husband who lives with her. basically, nothing is free. if you apply for assistance and aren't married, they can go after your childs father/mother regardless of where they live or whether you two are together or not. it sucks, because i had to name my daughters father so that all the free stuff i got would be paid for eventually by him...hope that helps. check your local social services website for info, it may help!
