It depends. As long as you don't use the photos commercially, I would say no. Supreme Court has held that individuals do not have a reasonable expectation to privacy outside of their home. If you are in public, you are open to public scrutiny.

Yes. You cannot take someone's photograph without their permission, especially if they are nude. Even if it is a public beach, you cannot just take photos and intend to show them anywhere without the subject's knowledge. That could expose you to a lawsuit. However, if you do not photograph their face, that would make identification less likely.
If they catch you at it, be prepared to get beaten up or have the cops sicced on you.

I think it is, But even if it isn't acts like that will cause all photos baned on public beaches.
That will mean that when you go to the beach with your young family, you won't be able to take family photos.
Think about it, if you want to see boobs, buy a magazine, there better quality shots, and your not stepping over the line of privacy.
