we had an areegment for rent to be paid every 30th of the month, but half of my payments comes in my a/c around the 10 of each month, which makes it hard for me to pay my full rent on the date areeged, my landlord calls me on the 31st of month saying i will have to leave the property even when i always make sure half of the rent is paid before the 30th of month and the other half is paid 3 to 4 days after. it is very stressful and i would like to know what are my rights.

Before going legal, have you tried talking to your landlord or the Agents and explaining your situation, due to my paydays I can only pay half on the due day but can pay the remainder a few days later, I had a similar problem but once the agents changed the pay by date on their computer and now me and the landlord are like that . Still waiting for the swine to fix the roof though.

You have a grace period, usually 5 days to pay your rent before they can evict you. Find out the laws in your state for the amount of days. Also make sure you have a written lease agreement. Read in it to see what it says about late rent in the agreement. In the meantime I would look for another place to live as soon as the lease is up.

Why don't you ask your landlord if you can change the due date of your rent so it matches up with your pay schedule?

It depends on your state, but generally your landlord is legally within his/her rights to issue an eviction notice if the *full* rent is not paid on time.

However, be aware that evictions are time-consuming and expensive for the landlords, and they rarely follow through on their intimidation. Unless, of course, they really want to get rid of you.

every where is different
the law in my city is different from the surrounding areas

here they can give you an eviction notice 1 hour after the rent is due but if you pay in full (including any penalties specified in the lease agreement) before the eviction date you are not evicted



(really you should start managing your money better and have a cushion so you can pay your rent)

well im not a lawyer but when i lived in a apartment we had a grace period rent was say do on the first but you had till the 4th to have it paid...it was helpful when you get paychecks on different days, thats usually how it is in most rental situations u shoudl get 4 days...hope this helps

THEN AT THAT HEARING A MOVE OUT DATE IS CHOSEN AND THEN A DAMAGES HEARING SCHEDULED AFTER THAT. IT SOUNDS LIKE YOUR LANDLORD MAY JUST BE TRYING TO SHAKE YOU DOWN WITH THREATS HE CANNOT MAKE REALITY. IF YOU ARE ONLY A FEW DAYS LATE, WHY HAVEN'T YOU ASKED IF YOU COULD AMEND YOUR LEASE AGREEMENT. REMEMBER LAWS ARE DIFFERENT EVERYWHERE.

Learn to budget properly, instead of living from paycheck to paycheck. You only need to save enough money to be one month ahead to avoid this issue completely.
