We have had surveyors come out and put pins in the ground to mark our land. They keep disappearing. He is wanting to put a fence up for his horses. Many people are telling me that he has to put his fence at least 3 foot inside the property line. I want to tell him this but need to find proof.

I am certain he has moved the landline markers several times. They have gone missing twice. Also he was really picky when we dug a ditch along our driveway. Water drains from his property as well in this ditch. He told us we needed to put the ditch on our side of line which we did. Now he's putting up a fence and it looks like its going on our land. I will probably have to call and pay a surveyor again.

He has to have enough room to maintain the fence from both sides without going on his neighbor's property.

A "Plat of Survey" is a drawing of the property and shows all buildings and structures located on it. If you're not sure you have one, it is required at all closings when property is bought/sold. It will probably be with your origional papers when the property was purchased. Sounds like a rather large rural area so the County building department would have jurisdiction. If the property is in an incorporated part of a town, city or village than the towns building department will prevail. Bring the plat of survey to the building dept. and they can easily look up the zoning rule that applies to your specific case. It is true that these rules change from place to place so your specific condition needs to be addressed individually.

Why would somebody want to give up three feet of their property, and how do you figure this would be legal? The only time that would come about would be if there were a requirement for an easement for access, ie, a driveway, otherwise, anybody tries to take MY property, even a 3 foot strip, is in trouble..

Certainly not. He can put his fence on his property line.

He must make sure there are no conveyances or rights of way that prohibit fences by contacting the city or county government.

In some cases he might need a permit, which will outline the rules.

Each township/city has their own rules.

Just have him go to the township and the property dept can help him.

We put up a fence, and we only needed 18 inches on the outside, and WE HAVE TO maintain that 18 inches. It must be mowed, etc.
