As with any 'victimless' crime, if you prohibit it, then this activity goes underground. Then there's the matter of putting people who may be 'sick' in jail, rather than in treatment.

Gangs would control an unregulated activity, and deny the income from taxes.

The civil liberties of adults to do any activity not hurting others. this would infringe on freedom.
