Myself I would say a person being wrongly convicted of the crime he didn't commit. That must be terrible as they have the shame of a crime they never commited and have lost their freedom and missing out on their lives they deserve.
That would be as bad if not worse than the rape.

i think the worst would be the man committing it and getting away with it cos that means he can go on to do it again.
people have their lives ruined by rape! and that means the longer a mans getting away with it, the more lives he can ruin, its usually a life sentence for a rape victim and each one of them deserve justice, no matter how hard it is to get it.
its really terrible to be wrongly accused and the person who wrongly accuses someone should be severely punished like a prison sentence. and out of all the innocent men who have been wrongly accused only literally a few would have been convicted, in the UK the conviction rate is around 5%. SO many guilty men are going free because the jury are so scared of convicting an innocent man.
the two will have devastating effects on both the rape victim and the wrongly accused, but surly the best thing is to have rapists locked up! and more needs to be done so that can happen.
its more often the women is telling the truth rather then lying, most sane women wouldn't put their selves through all the terrible treatment and humiliation from police and the courts if its just for revenge, more of those women need to be taken seriously!
the majority of accusations are the truth!!!

Both are wrong. However, the thought of an innocent man going to prision for a crime he didn't commit is very sad especially when the real criminal is walking free. In this instance, I feel very strongly that if a woman lies to the police about being raped, she is named and shamed and brought to trial for wasting police time causing hurt to someone innocent - instead, they get away with it. Imagine if it was your dad, brother, husband wrongly accused. Thanks to the joke of british law, rapists don't actually serve long enough in prison - in my town today, an illegral immigrant was jailed for sexually assulting several women after being arrested and let back into the community - his last victim a 7 year old girl - the sentence, 3 years - says it all.

Both are pretty horrendous in different ways but the one who got away with it would be the worst because that means that there is still a dangerous predator on the loose, free to commit the crime again and again.
The poor man who is convicted wrongly would be left with that cloud over his shoulders probably for the rest of his life.

Both situations are especially heinous because justice has been thwarted and a rapist is on the loose. However, I'd have to say that the first situation is worse because it has two victims (the woman who was raped and the innocent man) instead of one.

both are bad. at the end of the day, the bloke that was innocent will be branded a rapist when he gets out of jail, when one that has commited rape will have to live with it for life and it wont go away

I would say the innocent man going to jail. Jail is just as bad as we think it is. Plus I'd like to think the rapist who did the crime gets shot at some point on the street.

The criminal justice system has had an answer to this for centuries. It's called the presumption of innocence. It says that scenario 1 is worse, not just for rape but for every crime. I think it's our only sane option.

I wouldn't want to see anyone unjustly punished though, as we know, it happens a lot. Now more than ever, DNA is being used to vindicate people who were wrongly convicted. With DNA being pretty prevalent, this scenario should happen less going forward.

I would say the first is worse.

The worst is definately the innocent man being put away 100% As awful as it is a rapist getting away with it, I wouldn't want anyone being locked away for something they didn't do.
