I think you have answered your own question, it's illegal. To deprive someone of their liberty is a serious offence and would have serious implications for the detainer, in Court.

It may lead to the people arming themselves for protection to the point where anyone that has the look of MIB that comes knocking on there there door may get shot before they can ask any questions.

Well, if I did it, I would be arrested as kidnapping - but if the CIA does it pack your bags your on vacation to Gitmo.
