They can if he lied on his application...if he had a record and didn't disclose it in the original application, they can fire him at anytime for falsifying his application.

If he was honest about it...then they cannot fire him after the fact...they had their opportunity to "not" hire him in the beginning.

Yes they can. This is why it is best to be honest. One of my ex-coworkers got fired after 2 1/2 years because we got a new CFO and they re-ran background checks on all employees and found she had been fired from a previous job for stealing and spent time in jail for it.
