Check your deeds. As a rule of thumb in the UK when standing with your back to the house the left fence is yours and the right belongs to the neighbours. Doesn't always happen 'though.

Check your deeds, as others have said. If you don't have a copy, but have a mortgage, ask your lender to provide a copy - there may be a small charge. Your old solicitor may also have retained a copy - could be more expensive to get it from them tho! If in doubt, get legal advice, once you have the deeds.

Consult other neighbours too, to see what the general rule is in your street. You can't rely on which side stuff faces, as there are so many fence types and mistakes happen - plus people may have tried to 'steal' your right etc.

The general principle does not always apply - so beware. In my parents street it is in reverse> mad!

In MA it does not matter if you put the 'pretty side' facing in or away from your property. I checked when my neighbor put a fence in with the bad side toward my garden. My municipal office informed me that wasn't a rule.

Get a survey, I have to get one for the same reason on the other side of my property.

Is it possible to talk to the former owners? Talk to the neighbor and see what he says. If both agree, you will have your answer. If they do not agree, the only way is to get your lot surveyed. This cost me about $300, in 2000, when I moved to a new residence. In my case, I wanted to build a garage along one side of my lot and there was a existing fence. it turned out the backside of my lot was slightly bigger than the fence line, and I built accordingly.

Which side is the "pretty" side? When you build a fence, you are required to put the "pretty" side (the side without the brace boards) facing your neighbor(s). If you can see the brace boards on the fence, it's yours, if you only see boards and no braces, it's not.

Good luck! :)

Without a survey that shows the fence, the best and surest way is to have a survey done... it shows the property line. Anything 6" or more on your side is yours. Anything 6" or less from the line is joint owned.

Try moving the fence. If someone complains it probably isn't yours.
