I am planning on having a name for my busness other than my own. But, if I keep all accounts, taxes and eveything in my legal name, am I still required to file for a fictitious name?

Basically, the only thing the business name will be for is professional recognition.

In NY State, in order to work under a name different from your own (such as the one on your birth certificate or bank accounts) is to file (through an attorney and your court house) for a certificate of corporation. If you incorporate, you are able to protect your personal assests. You will, however, have to have your financials, such as a checking account, under the name of your corporation, while keeping your own name on personal accounts. An LLC (limited liability corporation) is typically the best way to go, but speak with a lawyer, particularly one who specializes in such matters and find out just what is required in your state.
