It's pay day today, & my boss has just told me he can't afford to pay me, He owes me £400. Do I walk out & lose the £400, or do I stick it for another week & lose £800?

Should've added ... I'm not the only one wanting paying, he's got a MAJOR cash flow problem & plenty of other people have been chaseing him for the funds!

To me there is truth in what my mum always told me - - - if you can't pay one lot this week you won't be able to afford to pay two lots next week. You don't say how long you've worked there, but you must have an idea of how the business is run. If he is putting off paying others too, looks like the slippery slope to me. Get out and get another job. But take advice from the job centre first, find out what would happen if you walked out? Would you be deemed to be putting yourself out of work? Would it be constructive dismissal? Would you be eligible for any money? Don't forget to get the name of the person who gave you the info.

If you think he genuinely can't afford to pay you, and that he intends to pay you next week, ask him to put something in writing stating these things. That way, you have physical evidence. Do you get payslips? Make sure they don't issue one for this week.
I've been in a similar situation, where every week I was fighting for the money they owed me in wages. I can tell you now, it doesn't get any better, particularly if you don't have a contract or if, God forbid, you don't pay your contributions (!)
Stick it out for another week if he gives you something in writing to guarantee that you'll get it. Otherwise, cut your losses. It's alright having loyalty, but that doesn't pay the mortgage does it?

I don't know what the laws are for you, however the law usually is not of assistance in these situations very quickly. Be up front and honest with your boss and ask when he expects to be able to pay you. If he has a good reason (e.g. Funds were deposited but are not available) and is planning on paying you extra for your inconvenience (AND YOU TRUST HIM) then stick it out. If you don't trust him to be able to pay you, or if he is unable or unwilling to discuss this with you get out of there fast, BUT tell him that you are unable to continue to work without pay and give him a number to contact you when he is able to pay for your services. Then start looking for another position.

What a nasty piece of work. It must be terrible working hard and then to be told "Sorry, i cannot pay you." You must feel awful and angry as well. If he has been paying you cash in hand and did not declare it then i think there is nothing you can do about it. If not, i am sure someone will help you. Horrible boss that :(

Obviously you are not in a trade union...you know...those nasty people...
In law this would probably be found, should you apply to an employment tribunal, to be an unlawful deduction of wages.
You can apply to your nearest tribunal, fill out a form and they will notify your employer that you have started to take action against him.
Should he dismiss you, he would have to find a lawful method of dismissal. This could also be challenged through the tribunal.
You would need to exhaust the employment law avenues before being able to pursue any action through the civil courts.
Next time...join a bloody union!!!!

That is a good question! Has he given you an assurance that he will pay you later? Because if he won't pay you now, then he probably won't pay later...I would demand my money and then walk out and report him to the government. Go find a job that pays you!

Go to the professional body ACAS which is the employees legal team. They will sort it out for you, he cant not pay you cause he cant afford it thats his problem not yours!

In the UK you have laws and I would inquire at the labor bureau and get advice.
