My friend just found out his ex-girlfriend had a child 2 years ago and just approached him telling him the child is his. If the child is his, will he have to pay child support back-pay of 2 years even though he just found out he is the father or will he start paying regular child support payments?

Hello,
Not sure where you are but in Canada it is possible.

First - Was there ever a paternity test done to show he
is indeed the father?

Now if father was never told child was his until now he may take this to court. Fight for nu payment of that time leading up to now.

Second- If mother was on Social Assistants (Known as Welfare), She has to have named father of child or sign
papers in order to ever receive assistants.
Papers stating to take father for child support.
(The government needs to recollect some or all money given out)

NOTE:
I don't think so because they would have came after him way before 2 years.
So why would he then have to pay for back support if she received support from Social Services?
(UN less they are the ones taking him for the back support not
the x girlfriends?)
I personally wouldn't put out one dime until test were taking.
Then if so ask himself," Am I going to be a part of
Baby Doe's life?"
If not then pay nothing and forfeit all paternal right of child.
It was her choice and hers alone to have, keep child.
On that note the father after signing can no longer have part of baby Doe's life.

I personally wouldn't be making those kind /s of answer over a cup of coffee myself.

PS Congratulations dad your have a son- Embrace or Erase

Good Luck and hope I helped you out.

My daughter had just went through the same thing,as a matter of fact she is just finishing up the paperwork today, first she had to seek a lawyer, and then it was entirely up to her on how far she wanted to go back for child support, my grand-daughter is now 2yrs.also and he is only being made to go back until November of 2006,so they only went back 4 months, and he knows that it is his child.

If she has just told him about the child then NO he doesn't have to pay back support.
I think your friend should ask for proof of paternity though.

Tell him to get a paternity test first to make sure the child is his--yes--if the child is his--he'll have to pay.
