i am doing a dissertation on zero tolerance of alcohol in drunk driving and i am looking to find out the laws and limits in different countries. can anyone help please?

I live in MI and its .07, I think its too low. Too many people get ruined by one night in their youth. I think that they need to allow easy access to breathalyzers for people, if it wasnt a money making skeem they would.

In Canada, section 253 of the Criminal Code creates a criminal offence if a person is operating or in care or control of a vehicle, whether or not it is in motion, while that person's ability to operate it is impaired by alcohol or drugs or if the person's blood alcohol content is over .08. Please note the details -- you can be found guilty even if you are UNDER .08 and even if the vehicle is stopped. For example, you can be found guilty even if you are passed out in the back seat of your car.

Section 254 creates an offence if a person refuses to give a breath or blood sample when a demand is made by an officer who has reasonable grounds to suspect the person has alcohol in their body or within the preceding three hours committed an offence under section 253.

There are defences to a section 254 charge (too complex to outline here), but unless a person has reasonable grounds (supported by medical evidence) to believe providing the sample will seriously endanger their health, the best policy is usually to provide the sample and fight the section 254 charge.

Since impaired operation and care and control are offences here, a foreign person with a foreign conviction for such an offence may be denied entry to Canada on the basis of criminal inadmissibility.

In Canada, anyone stopped and asked to provide a sample has the right to obtain legal advice and there are lawyers available 24/7 to do this. If you are stopped, CALL!

Last thing -- if stopped, do NOT admit to consuming any drugs or alcohol. Simply say, I don't want to talk about that.

.08 here in Indiana and illinois also I do believe. I think that is still a tad too high. WHy do people feel the need to drink and arm themselves with a weapon, their cars.

However so many get DWI after DWI. Everyone makes bad judgemant calls you deserve once..... But if you get one, you should have to be on provation, high fines, DWI classes, and community service, and not allowed to drive period for 1 year.

If caught driving it should be bumped up to 2 years. If you get picked up a second time your driving PRIVLEDGES should be gone for a min. of 10 years. Its not a right......... Its a privledge so if you abuse it you dont need it. I believe if they did more then people would think before they repeated this act.

My fathers neighbor has had 4. And 2 of them were while she was not supposed to be driving. SOMETHING NEEDS DONE

08 for New Mexico, U.S.A. Refusal to take a breath test results in loss of license. New change in our law by Court decision, however. If you are over the legal limit, but close to it (liked a 1.0, for example), the prosecutor has to have an expert witness to prove you were impaired. Also, to be stopped for drunk driving, a police officer has to have "probable cause." That means he/she must see you do something unsafe while driving. They can set up "checkpoints", but those are severely restricted in my state. They have to be a safe location; they have to be announced in advance; they cannot delay drivers for more than 10 minutes.

the limit is 0,5 g/l. the instrument used to check your "drunkness" is called etilometro in Italian, but I didn't find any translation in English, sorry. Anyway they have to check your alcohol twice within 5-10 minutes.
there is no distinction betweet drivers of cars, motorcycles or other means of transport.
they take 10 points off from your driving licence. (total points, 20)
if you got your driving licence less than 3 years ago, you loose your driving licence for up to 3 months.
if you refuse to be checked by the policemen when they stop you, you loose your 10 points anyway, even if you are sober.
the fine is between 258 and 1032 Euros.

When I was a student, a fellow student was once charged with being drunk in charge of a bicycle. She was pretty drunk and she was riding on a public road and the Brummie copper who nicked her did not seem to have a very good sense of humour.

New York State, USA. .08 is the limit for DWI. They recently lowered it from .10

well here in dublin it use to be that a male can consume a pint glass of beer and woman could have a half pint of beer and if your stopped but the police on the roads they have a breath test for you to take and if its over your limit you get two points on your licience.

By the way, I think that stupid drivers should be punished just as severely whether they are sober or not because they are an even greater detriment since there is no breathalizer for stupidity.
