i want to see my daughter, there is no legal custody. i am legally the father. i live in a differnt state and the state she lives in filled neglect against the mother. should i go get my daughter and then file? she has denied me visitation, and threatens to hide my daughter from me. she has had many charges the past 4 months and i dont want the state to take my daughter. and i dont want the state to think i have abbandend her, i moved to get a job. she wont work with me in any way.

what if i have a violation of probation for driving without a licence. i was on probation for a year i paid some money but i didnt complete it, but my fiens are being paid. if my fines are paid by the time i go get my daughter and i get a lawyer, do i have a chance.

You need an attorney, yes it is expensive.

The attorney actually proves to the court that the child is important enough for you to commit your money as well as your time. Yeah, they are not supposed to care about things like that just like they are not supposed to care about being arrested and released or race or sex or religion.

Switch lawyers as little as possible, depending on the child's age and your actions to see and participate in the life of the child you may have a chance.

If all lawyers and judges were blind justice itself would still be bigoted. Money walks and poverty does time.

get together all the proof you have of being her father and get in touch with the dept. of child and family services..ask to speak with the person in charge of your daughters case..the office closest to where your ex resides would most likely be the one handling it...explain that it is your intentention to file for sole custody of your daughter..you will have to go to court where they live and prove yourself worthy of being the custodial parent, but from the sound of things you should not have too many problems...in the meantime request that you be awarded emergency intervention custody..believe it or not the state intervening and taking your daughter away from the mother is very helpful to your case..just let them know you exist and are willing to take custody so they don't place her in foster care..you will need to take considerable time away from work to accomplish all this..if you have the means i recommend retaining a lawyer with some family court experience.

Your best bet would be to hire a lawyer and contact the DHS and tell them who you are chances are your ex is being monitired because of the abuse.You maybe able to file for custody of the child through a lawyer.Its worth a try.

File a petition in court to have a visitation rights and custody of your daugther so that the court will order your wife to respect your rights. Support your claim with proper documents and financial ability to support your daugther.
