Ok well my boyfriend is 18 and I am 16. We are only two years apart. He turned 18 in September and I turned 16 in October in 06. With the statutory rape law could he still be convicted if we had intercourse???

As stupid as it is yes he could, why don't the police go after the real criminals here? They don't arrest or even look into a woman being sexually abused, they just say I don't know if it was on our county line. The first time a woman or girl speaks up and nothing is done, this pisses them off and then they come off with lets get the boyfriend. There is a big difference in a 18-15 or 16 year old than a 14-15-16 you get the point sleeping with a 40 year old, that is statutory rape or when any woman or girl says no, or is drugged. But to go after someone just because they are dating and having sex before everyone else thinks they should be they are the ones that get hell for it, not the real bastards. Word of advice, DON'T TELL ANYONE IF YOU DO IT!!!!!!!!!!!!!!!!!!!!!!!!!!!! I am a mom of a 15 year old and her boyfriend is 18, I thought they had sex and someone turned him in. They say a 15 year old is not as mature as a 18 year old, I can prove them wrong. Everyone matures differently and my daughter and her boyfriend act the same age and sometimes he acts younger. It is also known that girls mature 2 years before boys do. Good luck

Yes, it's illegal. The age of consent is 18 in California. If you have sex with anyone over the age of consent before you're 18, they could face charges. A person convicted of statutory rape must register as a sex offender...it's just not worth it, in terms of what it could do to your boyfriend's future.
