i was engaged about a year ago, and it fell through. (she found another man while i was gone.) Is there any way that i legally could get that back ? i paid 3000 dollars for it and would like to have it back, but to deal with her crap it might be worth just writing it off. What would you do ? and how would you get it back ??

deal with the crap and get it back... she really should have given it back to you if she was somewhat of a decent person

ask her for it back, maybe even talk to one of her friends/family to talk to her about given it back to you if she still gives u crap then SUE her

because i THINK the ring can be considered as a contract where she gets to keep the ring as long as she marries u and if that does not go through she doesn't have any legal entitlement to it

If you can prove that she still has the engagement ring then take her to Court. It depends on who broke the engagement, if she did, then she should give it back, if you did she has no obligation to return the ring.

Suggestion, chalk this up to experience and move on. Next time do a Pre-Nuptial Agreement.

Courts have gone two ways on this issue. First, it is a gift, and once you have given it, you have ceded all claim and control over the property. Second and more common, it is a conditional gift. That's right, you gave it to her but it was subject to her following-through on a commitment to marry you.

Take it to small claims and make the second argument.

I regret to inform you, unless there was a pre-nuptial agreement you stand to gain nothing, since an engagement ring is considered a gift, you are without recourse, unless you have some kind of agreement.

very simple. small claims court if you do not want to deal with her....in every state an engagement ring is given, " in contemplation of marriage. if no wedding you get the ring back.

You can take her to small claims court if she broke off the engagement. If she is that big a pain write it off as a bought lesson.
